Capability 02
EHS legal expertise.
Expert support for counsel in litigation, claims, and regulatory matters.
What this covers
When an EHS question becomes a legal one, counsel needs a technical expert who can read the record, apply the standard, and say plainly what it shows. KEGL Services provides that support in litigation, claims, and regulatory matters.
- Record review. Program documents, training and exposure records, inspection histories, and incident files: what they establish, what they do not, and where the gaps are.
- Standard-of-care and causation analysis. What a reasonable program would have required at the time, measured against the governing regulations and consensus standards, and whether the record supports the chain of events alleged.
- Opinion support. Written opinions, review of opposing expert reports, and support through deposition and testimony.
- Regulatory matters. Technical support in responding to citations and inspection findings, including abatement verification.
How we engage
Work in this capability is provided in support of and at the direction of counsel. KEGL Services does not provide legal advice. We run a conflicts check before accepting any matter, work within the structure counsel sets, and keep our opinions to what the record and the standards support.
What counsel receives
Analysis that cites its sources, written so that a judge, an adjuster, or a regulator can follow it. Plain statements of what can and cannot be shown. No overreach, because overreach is what opposing experts are paid to find.
Talk to us about a matter.
Tell us about your program and your obligations. We will tell you, plainly, whether and how we can help.
